Terms of Service
PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING MYSEARCHHERO. BY ACCESSING OR USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE OUR SERVICES.
1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and MySearchHero ("Company," "we," "us," or "our") governing your access to and use of the MySearchHero platform, website, and all related services (collectively, the "Services").
By creating an account, initiating a trial, or making a payment, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal authority to enter into this agreement; (c) your use of the Services will comply with all applicable laws and regulations; and (d) all information you provide to us is accurate and complete.
2. Description of Services
MySearchHero provides an automated organic search visibility and social media marketing platform that includes the following components:
The Services are provided on a subscription basis. Individual components of the Service are fulfilled in part through third-party vendors. While we manage these vendor relationships on your behalf, the underlying delivery of certain features is subject to third-party platform availability and policies.
- AI-generated SEO content published to your connected website or CMS
- Authority backlink building through a third-party publisher network
- Click-through rate (CTR) amplification via real human click signals
- Reddit community presence placement and monitoring
- Automated social media content generation and publishing across connected platforms
- LLM and AI search visibility tracking
- Client dashboard and reporting tools
3. Subscription, Trial, and Billing
3.1 Trial Period
We offer a three (3) day trial period at no charge. A valid payment method is required to initiate the trial. The trial provides full access to all platform features. At the conclusion of the trial period, your subscription will automatically convert to a paid monthly subscription at $487.00 USD per month unless you cancel prior to the end of the trial period.
3.2 Subscription Billing
Following the trial period, your payment method will be charged $487.00 USD on a recurring monthly basis. Billing occurs on the same calendar date each month as your conversion from trial to paid subscription. All fees are non-refundable except as expressly stated in Section 5 (Money-Back Guarantee) of these Terms.
3.3 Payment Methods
We accept major credit cards and debit cards processed through our third-party payment processor. By providing payment information, you authorize us to charge all fees incurred through your account. You represent that you are authorized to use the payment method provided.
3.4 Failed Payments
If a payment fails, we will attempt to recharge your payment method up to three (3) times over a seven (7) day period. If payment is not received within this period, your account will be suspended and access to the Services will be restricted. Reactivation requires payment of all outstanding balances.
3.5 Price Changes
We reserve the right to modify subscription pricing with thirty (30) days advance written notice via email to your registered email address. Your continued use of the Services following the effective date of a price change constitutes your acceptance of the new pricing.
4. Cancellation
You may cancel your subscription at any time by contacting us at support@mysearchhero.com or through our customer billing portal. Cancellation requests must be submitted at least 48 hours prior to your next billing date to avoid being charged for the subsequent billing period.
Upon cancellation: (a) your access to the Services will continue through the end of your current paid billing period; (b) no partial refunds will be issued for unused portions of a billing period except as provided under the Money-Back Guarantee in Section 5; (c) all data associated with your account may be deleted after 90 days following cancellation.
We reserve the right to cancel or suspend your account at any time for breach of these Terms, non-payment, or activity that we determine, in our sole discretion, to be harmful to the Services, other customers, or third parties.
5. Money-Back Guarantee
5.1 Eligibility
To be eligible for a refund under the money-back guarantee, you must: (a) be a new first-time subscriber; (b) submit a refund request to support@mysearchhero.com within 45 days of your initial paid subscription start date (not the trial start date); (c) have provided a valid website URL and completed the onboarding intake process; and (d) have allowed the Services to run for a minimum of 30 continuous days prior to requesting a refund.
5.2 Refund Process
Upon receipt of a valid refund request, we will review your account within five (5) business days and issue a refund to your original payment method within ten (10) business days of approval. Refunds are limited to one (1) subscription payment and do not include any applicable trial fees.
5.3 Exclusions
The money-back guarantee does not apply in the following circumstances:
- Accounts terminated for violation of these Terms
- Customers who have previously received a refund from MySearchHero
- Accounts where the onboarding intake was not completed
- Refund requests submitted after the 45-day eligibility window
- Accounts suspended for fraudulent activity or payment disputes
6. AI-Generated Content - Disclaimer and Client Responsibility
MySearchHero generates content automatically using artificial intelligence based on information provided during onboarding and from publicly available information about your business and industry. WE MAKE NO WARRANTY THAT AI-GENERATED CONTENT ACCURATELY REPRESENTS YOUR BUSINESS, PRODUCTS, SERVICES, BRAND, OR ANY OTHER ASPECT OF YOUR OPERATIONS.
You are solely responsible for reviewing all content published to your website and social media accounts and ensuring its accuracy, completeness, and compliance with applicable laws. You retain the right to edit, unpublish, or delete any content published to your website or social media accounts at any time through your respective platform dashboards. MySearchHero shall not be liable for any damages, losses, reputational harm, regulatory action, or claims of any kind arising from inaccurate, misleading, incomplete, or objectionable AI-generated content.
By accepting these Terms, you acknowledge that AI-generated content may occasionally contain errors, inaccuracies, or information that does not reflect your business accurately, and that ongoing review of published content is your responsibility.
7. Backlink Network - Disclosure and Limitations
7.1 Network Operation
Backlinks are built through a third-party contextual exchange network in which your website participates alongside other businesses. Backlinks are placed naturally within articles published across niche-relevant websites within the network. By using the Services, you consent to your website participating in this network both as a recipient and as a host of backlinks placed on your behalf.
7.2 Competitor Placement
The backlink network operates as a mutual exchange system in which your website may receive backlinks from, and provide backlinks to, other businesses within the network, including businesses that may compete with you in your local or national market. To minimize placement on competitor websites, you must identify your direct competitors during onboarding or at any time by updating your competitor list in your account settings. MySearchHero does not guarantee exclusion from any specific website within the network.
IF THE POSSIBILITY OF YOUR CONTENT OR BACKLINKS APPEARING ON A COMPETITOR'S PLATFORM IS NOT ACCEPTABLE TO YOU, DO NOT ACCEPT THESE TERMS OF SERVICE AND DO NOT USE THE SERVICES.
7.3 Backlink Permanence
Backlinks built through the MySearchHero network are placed within third-party publisher content and are intended to remain in place. However, MySearchHero cannot guarantee the permanent retention of any specific backlink as third-party publishers retain full editorial control over their own content. MySearchHero makes no warranty regarding the permanence of any individual backlink and shall not be liable if a third-party publisher removes, modifies, or discontinues content containing your backlink.
7.4 Backlink Removal
MySearchHero does not offer backlink removal services. Once placed, individual backlinks cannot be removed by MySearchHero upon client request as we do not control the third-party publisher sites. If you require removal of specific content from third-party sites, you must contact those publishers directly.
8. CTR Amplification - Disclosure and Risk Acknowledgment
MySearchHero's click-through rate amplification service uses real human users to generate organic-pattern search activity on your target keywords. You acknowledge and agree that:
If you do not consent to CTR amplification or do not accept the associated risks, you must notify us at support@mysearchhero.com and we will disable this feature for your account.
- CTR amplification services may not be endorsed by or fully compliant with Google's webmaster guidelines or the terms of service of other search engines
- The use of CTR amplification carries inherent risk including the possibility of negative impact on your search rankings, website traffic, or search engine account standing
- MySearchHero shall not be liable for any penalty, ranking decrease, traffic loss, or search engine action of any kind resulting from CTR amplification activities conducted on your behalf
- By accepting these Terms you expressly acknowledge these risks and consent to CTR amplification being conducted on your behalf
9. Reddit Presence - Disclosure and Limitations
MySearchHero places brand mentions and content within Reddit communities using managed accounts that operate in accordance with Reddit's published terms of service. You acknowledge and agree that:
- Reddit moderators and administrators retain sole discretion over content removal and account actions on their platform
- MySearchHero cannot guarantee that any specific Reddit post, comment, or mention will remain live
- In the event that a placed post or comment is removed by Reddit moderators, MySearchHero may at its sole discretion provide a partial credit or replacement placement but is under no obligation to do so
- MySearchHero shall not be liable for any Reddit account actions including bans, shadow bans, content removal, or any other platform action
- Managed accounts used for Reddit placement are operated by MySearchHero and will not be transferred to you
10. Social Media Publishing - Disclosure and Platform Responsibility
MySearchHero publishes AI-generated content to your connected social media accounts on your behalf. You acknowledge and agree that:
- You are solely responsible for maintaining valid, active social media accounts in good standing with each respective platform
- You represent that you have the legal authority to connect your social media accounts to the MySearchHero platform and that doing so does not violate any platform's terms of service
- MySearchHero shall not be liable for account suspensions, bans, reduced reach, content removal, or any other action taken by social media platforms against your accounts as a result of content published through MySearchHero
- Social media platform algorithms and policies change frequently and MySearchHero makes no guarantee regarding the reach, engagement, or performance of published content
- You retain the right to disconnect your social accounts and unpublish any content at any time through your respective platform dashboards
11. Third-Party Vendor Dependency
MySearchHero's platform relies on third-party vendors and service providers to deliver certain features. These vendors include but are not limited to content generation providers, backlink network operators, social media scheduling platforms, Reddit presence providers, and click signal providers. You acknowledge and agree that:
- MySearchHero does not guarantee uninterrupted availability of any feature dependent on third-party services
- In the event a third-party vendor discontinues service, modifies its offering, becomes unavailable, or materially changes its platform, MySearchHero reserves the right to substitute an alternative vendor or modify the affected feature without liability
- Third-party vendors have their own terms of service and privacy policies which may apply to the processing of your data
- MySearchHero is not responsible for the acts, omissions, or policies of any third-party service provider
12. Algorithm and Platform Change Disclaimer
Search engine algorithms, social media platform policies, AI training data practices, and digital marketing best practices are subject to change at any time without notice by third parties including Google, Meta, TikTok, Reddit, OpenAI, and others. MySearchHero does not guarantee that any specific strategy, tactic, feature, or approach will remain effective following such changes. Changes to third-party platforms may impact the performance or availability of certain features. MySearchHero shall not be liable for any negative impact on your business resulting from changes to third-party platforms, search engine algorithms, or industry practices.
13. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:
- In any way that violates applicable federal, state, local, or international laws or regulations
- To submit websites that contain illegal content, promote illegal activity, or violate the rights of any third party
- To submit websites that contain malware, spyware, phishing content, or other harmful code
- To attempt to gain unauthorized access to any portion of the Services or related systems
- In connection with adult content, gambling, controlled substances, or other restricted categories
- To misrepresent your identity, your website, or your business to obtain Services
- To resell or sublicense the Services to third parties without our express written consent
14. Intellectual Property
14.1 Our IP
The Services, including all software, algorithms, content, designs, trademarks, and other materials created by or on behalf of MySearchHero, are owned by or licensed to MySearchHero and are protected by intellectual property laws.
14.2 Content We Create For You
SEO articles, social media posts, and other content created by our platform and published to your website or social accounts are provided under a non-exclusive license for use on your designated platforms. You may edit, delete, or unpublish this content at any time. We retain the right to use anonymized performance data from content created through the platform for product improvement and marketing purposes.
14.3 Your Content
You retain ownership of your website, brand assets, and any materials you provide to us. By using the Services, you grant MySearchHero a non-exclusive, royalty-free license to access, analyze, and use your website content and data solely for the purpose of providing the Services.
15. No Guarantee of Results
MYSEARCHHERO DOES NOT GUARANTEE ANY SPECIFIC SEARCH ENGINE RANKING, TRAFFIC VOLUME, SOCIAL MEDIA FOLLOWING, ENGAGEMENT RATE, AI CITATION FREQUENCY, VISIBILITY OUTCOME, OR BUSINESS RESULT. Results depend on many factors outside our control including but not limited to:
Case studies, testimonials, and performance metrics shared in our marketing materials represent individual results and are not representative of typical outcomes. Past performance is not indicative of future results.
- Google and other search engine algorithm updates
- Social media platform algorithm changes
- Competitor activity and domain authority
- Your website's existing technical health and content quality
- Industry competitiveness and keyword difficulty
- Geographic targeting and market saturation
- Third-party platform availability and policy changes
- The accuracy and completeness of information you provide during onboarding
16. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYSEARCHHERO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYSEARCHHERO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, GOODWILL, DATA, REPUTATION, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
IN NO EVENT SHALL OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOU TO MYSEARCHHERO IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
18. Indemnification
You agree to indemnify, defend, and hold harmless MySearchHero and its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms
- Your use of the Services
- Content published to your website or social media accounts through the platform
- Your use of CTR amplification services
- Backlinks placed on your behalf
- Reddit community presence activities conducted on your behalf
- Any claim by a third party that content published through the platform infringes their intellectual property rights
- Your violation of any third party's rights
- Your violation of any applicable law or regulation
19. Force Majeure
MySearchHero shall not be liable for any failure or delay in performance resulting from causes beyond its reasonable control including but not limited to acts of God, natural disasters, pandemic, war, terrorism, government action, internet outages, cyberattacks, third-party service failures, or any other event beyond our reasonable control. Performance will be excused for the duration of such event.
20. Governing Law, Dispute Resolution, and Statute of Limitations
20.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.
20.2 Statute of Limitations
ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE EVENT GIVING RISE TO THE CLAIM, REGARDLESS OF ANY STATUTE OF LIMITATIONS TO THE CONTRARY. CLAIMS NOT BROUGHT WITHIN THIS PERIOD ARE PERMANENTLY BARRED.
20.3 Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us at support@mysearchhero.com and provide a written description of the dispute. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice.
20.4 Binding Arbitration
If informal resolution fails, any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Texas. The arbitrator's decision shall be final and binding.
20.5 Class Action Waiver
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION AGAINST MYSEARCHHERO. ALL CLAIMS MUST BE BROUGHT INDIVIDUALLY. YOU AND MYSEARCHHERO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
21. No Employment or Agency Relationship
Nothing in these Terms creates any partnership, joint venture, agency, franchise, or employment relationship between you and MySearchHero. You have no authority to make or accept any offers or representations on our behalf.
22. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by email to your registered email address and/or by posting a notice on our website at least fourteen (14) days prior to the effective date of the changes. Your continued use of the Services after the effective date constitutes your acceptance of the changes.
23. Modification of Services
MySearchHero reserves the right to modify, suspend, or discontinue any feature, service, or aspect of the platform at any time with or without notice. We may add, remove, or alter features as we see fit to improve the platform. Continued use of the platform following any modification constitutes acceptance of the change. MySearchHero shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
24. Miscellaneous
24.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MySearchHero with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.
24.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
24.3 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
24.4 Assignment
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction.
